Privacy Policy

1. Information We Collect

PresNa LLC ("PresNa," "we," "us") collects the following categories of information:

  • Account information: name, email address, firm name, practice area, and billing information provided during registration.
  • Usage data: dashboard activity, feature usage, login timestamps, and device/browser information.
  • Client conversation data: messages exchanged between your website visitors and your PresNa AI assistant. This data belongs to you and is processed on your behalf.
  • Communications: emails, support requests, and feedback you send to us.

2. How We Use Your Information

  • To provide, maintain, and improve the PresNa platform
  • To configure and personalize your AI assistant for your practice
  • To process payments and manage your subscription
  • To send service notifications, updates, and support communications
  • To comply with legal obligations

3. Information We Do Not Do

  • We do not sell, rent, or license your personal information or your clients' conversation data to any third party.
  • We do not use client conversation data to train AI models — yours or ours.
  • We do not share your data with advertisers.

4. Data Security

All data is encrypted in transit using TLS 1.2+ and at rest using AES-256. Access to customer data is restricted to authorized PresNa personnel on a need-to-know basis. We maintain SOC 2-aligned security practices.

5. HIPAA and Medical Clients

For medical and dental practice clients, PresNa operates as a Business Associate under HIPAA. We provide a Business Associate Agreement (BAA) upon request. Client conversation data collected through medical deployments is handled in accordance with HIPAA requirements. To request a BAA, contact hipaa@presna.io.

6. Data Retention

We retain your account data for the duration of your subscription and for 90 days following cancellation, after which it is permanently deleted. You may request deletion at any time by contacting privacy@presna.io.

7. Third-Party Services

PresNa uses the following sub-processors to deliver our service: Anthropic (AI processing), Stripe (payment processing), Supabase (data storage), Resend (email delivery), and Netlify (hosting). Each operates under its own privacy policy and data processing agreement.

8. Your Rights

You have the right to access, correct, or delete your personal data. To exercise these rights, contact privacy@presna.io. GDPR data deletion requests are honored within 72 hours.

Terms of Service

1. Acceptance of Terms

By accessing or using PresNa's platform and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all subscribers, users, and visitors.

2. Description of Service

PresNa provides AI-powered client communication tools for professional service firms, including 24/7 chat widgets, automated client intake, lead capture, compliance guardrails, and optional add-ons including Voice AI, CRM integration, and custom AI training. Services are delivered on a monthly subscription basis.

3. Free Trial

New subscribers receive a 14-day free trial. No charges are applied during the trial period. Your payment method is saved at signup but not charged until day 15. You may cancel before day 15 with no obligation. After the trial, your subscription automatically renews monthly.

During the free trial, the AI Voice receptionist is fully active so you can experience it on real calls, subject to a trial allowance of 60 AI voice minutes. This trial allowance is intended for evaluation only; once the trial converts to a paid subscription, your monthly allowance increases to your plan's full included minutes (Essential 300, Professional 600, Pro+ 1,500). If the trial allowance is reached before your trial ends, the AI receptionist will pause until your plan begins.

4. Subscription Plans and Pricing

Every plan includes the AI Voice receptionist, the AI chat widget, lead capture and dashboard, industry compliance guardrails, and managed installation. Plans differ by the number of included AI voice minutes per month and by advanced features.

  • Essential — $199/mo: AI Voice receptionist with 300 voice minutes/mo, AI chat widget, lead capture & dashboard, compliance guardrails, managed installation, email support.
  • Professional — $349/mo: Everything in Essential plus 600 voice minutes/mo, CRM integration, lead qualification & scoring, multiple team members, and priority support.
  • Pro+ — $599/mo: Everything in Professional plus 1,500 voice minutes/mo, custom AI training, multiple locations, a dedicated account manager, and an SLA guarantee.

All prices are in USD. Prices may change with 30 days' advance notice.

5. Add-On Services

Optional add-on services (such as CRM Integration and Custom AI Training, where not already included in your plan) are billed as separate monthly line items on your Stripe subscription and may be cancelled independently of your base plan. The AI Voice receptionist and AI chat are included in every plan and are not separate add-ons.

6. Voice AI Usage and Overage Minutes

Each plan includes a monthly allowance of AI voice minutes (Essential 300, Professional 600, Pro+ 1,500). A "voice minute" is measured as connected AI call-handling time, rounded up to the nearest minute per call. Minutes reset at the start of each monthly billing cycle and do not roll over. If you exceed your included minutes, additional minutes are billed at $0.40 per minute and invoiced at the start of the following billing cycle. PresNa notifies you when you reach 80% of your included minutes so you can monitor usage. Most firms never reach their included limit. During the 14-day free trial a reduced evaluation allowance of 60 voice minutes applies (see Section 3); trial minutes are not billed and no overage is charged during the trial — the AI receptionist simply pauses if the trial allowance is reached.

6a. Call Forwarding and Recording Consent

The AI Voice receptionist works by call forwarding: you forward your existing business line to the dedicated PresNa number using your carrier's forwarding codes. You are responsible for configuring and disabling forwarding on your own device and for any carrier charges associated with call forwarding. Calls handled by the AI may be transcribed and, where enabled, recorded so that captured leads and call summaries appear in your dashboard. You are solely responsible for providing any caller notice or obtaining any caller consent required by federal and state call-recording and consent laws (including "two-party" / all-party consent states) and the Telephone Consumer Protection Act (TCPA). PresNa's greetings can include a recording disclosure on request, but you remain responsible for legal compliance in your jurisdiction.

7. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard or by contacting hello@presna.io. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial months. If you cancel during the 14-day free trial, no charge will be applied.

8. AI Assistant Disclaimer

The PresNa AI assistant (chat and voice) is designed to handle general inquiries and client intake. It is expressly not a substitute for professional legal, medical, financial, accounting, or other licensed professional advice. You are solely responsible for ensuring that AI-generated responses comply with applicable professional standards, bar association rules, licensing requirements, and regulations in your jurisdiction. PresNa's compliance guardrails are designed to assist with this but do not guarantee compliance.

8a. Industry-Specific Compliance Guardrails (Chat and Voice)

PresNa applies the same compliance guardrails to both chat and voice interactions, tailored to your industry. These guardrails instruct the AI to identify itself as an AI assistant, decline to give professional advice, and route callers to a licensed professional or scheduled consultation. By industry:

  • Legal: The AI does not provide legal advice, legal opinions, or case strategy, does not collect privileged or confidential case details, and operates consistent with ABA Model Rules of Professional Conduct. It directs substantive legal questions to a consultation with a licensed attorney.
  • Accounting / Tax: The AI does not provide tax advice, prepare returns, or interpret tax law for a specific situation, consistent with IRS Circular 230 limits on practice. It routes tax questions to a licensed CPA or enrolled agent.
  • Medical / Dental: The AI does not provide medical diagnosis or treatment advice, minimizes collection of protected health information (PHI), and is intended to operate under a Business Associate Agreement where required by HIPAA. It instructs callers experiencing a medical emergency to hang up and dial 911.
  • Real Estate: The AI follows Fair Housing Act requirements and does not steer, discriminate, or make representations based on protected characteristics. It routes specific transaction, pricing, and contract questions to a licensed agent.
  • HR / Recruiting: The AI follows EEOC and ADA principles, does not ask discriminatory or prohibited pre-employment questions, and routes employment decisions to a qualified human.

These guardrails reduce risk but do not guarantee compliance. You remain responsible for reviewing AI interactions and for compliance with the laws and professional rules governing your practice.

9. HIPAA

Medical and dental clients may request a Business Associate Agreement (BAA) from PresNa prior to deployment. Deployment without an executed BAA where one is required may violate HIPAA. Contact hipaa@presna.io to request your BAA.

10. Acceptable Use

You may not use PresNa to: violate any applicable law or regulation; impersonate any person or entity; transmit spam or unsolicited communications; collect personal information without appropriate consent; or engage in any activity that could harm PresNa's infrastructure or other customers.

11. Limitation of Liability

To the maximum extent permitted by law, PresNa's total liability for any claim arising from use of the Service shall not exceed the amount you paid to PresNa in the 3 months preceding the claim. PresNa is not liable for indirect, incidental, consequential, or punitive damages.

12. Service Availability

PresNa targets 99.9% uptime for all plans. Pro+ plan subscribers receive an SLA with defined remedies for downtime. Scheduled maintenance windows will be communicated in advance. PresNa is not liable for outages caused by third-party services (Anthropic, Stripe, Netlify, etc.).

13. Modifications

PresNa reserves the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email. Continued use of the Service after notice constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Disputes shall be resolved in the courts of Laramie County, Wyoming.
